To Your Health: Your Consumer Rights in Managed Health Care

This 74-page consumer guide to managed health care, revised in summer 2008, is available free-of-charge as part of the Law Project’s “To Your Health” program. Simply call the CHLP and ask us to send you a copy. The book explains the distinction between traditional fee-for-service insurance plans and managed health care plans (e.g., HMO, POS, PPO); outlines consumers’ rights and responsibilities under managed care; describes the grievance and appeal procedures of commercial, Medicare, NJ FamilyCare, and Medicaid health insurance plans; provides sample letters and phone conversations that consumers can use when calling an insurance company about a complaint or appeal; and covers federal and state laws such as COBRA, HIPAA, and the Mental Health Parity Act. It also has a useful resource guide with the contact information for state and federal government offices, advocacy organizations, disabilities groups, and legal aid organizations.

Medicaid Managed Care Supplement

This 20-page supplement to "To Your Health" addresses managed care issues specific to New Jersey Care 2000+, a mandatory Medicaid managed care program that is being phased in by the New Jersey Department of Human Services. It explains how Medicaid managed care differs from traditional fee-for-service Medicaid, how to choose a Medicaid HMO, which services will continue to be covered by fee-for-service Medicaid even for people in a Medicaid HMO, and how to apply for an exemption from Medicaid managed care.

 

Community Resident Rules

Good Neighbors: Laws, Rules and Policies Affecting Community Residences, Apartments, and Houses for People with Disabilities

This 51-page book, revised in 2004, explains the state and federal laws governing community residences, apartments, condominiums, and houses for people with disabilities --e.g., the Americans with Disabilities Act, the federal Fair Housing Amendments Act, the New Jersey Municipal Land Use Law. In an easy-to-understand question-and-answer format, it provides examples of the protections available under the law. It is intended for consumers, service providers, and municipal officials.

Fair Housing

Fair Housing Law for Persons with Disabilities

This 24-page manual, written in 2005, reviews state and federal laws that protect people with disabilities from housing discrimination. The manual is organized in a question-and-answer format and includes citations to statues and regulations, websites where those sources can be accessed without cost, and instructions for filing a housing discrimination complaint with the U.S. Department of Housing and Urban Development and the New Jersey Division on Civil Rights.
